TERMS AND CONDITIONS OF SALE

MAIN CLAUSES

Our selling is subject to the hereby referenced terms and conditions. They prevail on any selling situation – except in case of a written and express dispensation on our part.

ORDERS

All orders can be addressed to La malle aux accordéons via this website, email or regular mail. All items included in the order, except those not available on the date of the receipt of the order or the treatment of the order will be shipped to the address given by the Customer. In case of unavailability, La malle aux accordéons will notify the Customer via mail or email, and specify the date of availability of the item(s) so that the order, total or partial, can be shipped as soon as possible.

The Customer reserves the right to cancel or modify the entire order in case of partial unavailability. For this right to be effective, our Customer has a seven-day period after receipt of the parcel to update their order. If no modification of the order is expressly asked for, the items will be shipped according to the delivery time specified on the notification.

PRICE AND TERMS OF PAYMENT

The prices displayed on the website and on our invoices are expressed in Euro (all taxes included) – only accepted currency. La malle aux accordéons reserves the right to change these prices between the receipt of the payment and the shipping of the parcel, and is required to inform the Customer. The latter is entitled to choose between the reimbursement of the already completed payment, or the payment of the reported differences.

SECURITY

Our website offers a professional payment interface. All transactions are guaranteed secure as well as confidential.

SATISFIED OR REIMBURSED

The Customer has a period of seven days after receipt of the parcel to change their mind. If the item doesn’t suit them, they can return it and ask for an exchange or a refund.

RETURNING AN ITEM

To return an item: contact us for an express agreement on our part. We will give you a Return Number; then, send us back the item in its original package along with the invoice and the material, and address it to: La malle aux accordéons, 20 rue de Lorraine, 34070 Montpellier. The shipping costs (back and forth) are at the expense of the Customer. The items need to be returned by registered post. For the invoices paid by credit card, a sum equal to the bank charges imposed upon us will also be deducted. If the Customer returns an item for an inspection and the item turns out to be in good working order, the item will stay at the Customer’s disposal in our commercial premises. The potential re-shipping costs will be at our Customer’s expense.

DEADLINES, RETURNS, DISPUTES, CONTESTINGS

The shipping costs are paid to the post or the carrier in the name and on behalf of the Customer. Normally, our orders are shipped in a time period of 24 hours to 15 days. However, depending on other partners for the shipping, La malle aux accordéons cannot guarantee this time period, given as a reference. La malle aux accordéons strongly recommends their Customer to check the parcel in the presence of the deliverer. In case of material damage, the Customer should report it on the deposit slip given by the deliverer. In case of non-delivery, the Customer is requested to notify us within weeks after ordering.

LATE PAYMENT AND LACK OF PAYMENT

In the case where the Customer lacks in the payment of any sum due to La malle aux accordéons, we reserve the right – with or without notice – to suspend any shipping to the Customer until they have paid the due sum(s). In case of proceedings, the Customer will bear all expenses engendered for the reimbursement of the due sums. By express agreement, the lack of payment by the time of the imparted deadline will lead to the immediate payability of any sum that is still due, whichever method of payment initially chosen on one hand. On the other hand, as a penalty clause, the amount to be paid will be increased by 15%, in addition to legal interests and possible proceedings costs.

TITLE-RETENTION CLAUSE

We retain the ownership of sold items until the effective payment of the entire principal and secondary amounts due. A lack of payment of any due date can lead to a claim of the properties. This disposition does not constitute an obstacle to the transfer to the Customer leaving the depot, the risks of loss or deterioration of sold goods, or to the damage they could cause. In application of the legal dispositions, the sold goods remain our property until complete payment of the price and accessories.

COPYRIGHTS

Any total or partial representation or reproduction executed without the consent of the author, their beneficiaries or La malle aux accordéons is unlawful.

WARRANTY

The minimum legal term of warranty is 1 year (as from the date of the invoicing). The longer terms of warranty are notified on the website or the invoicing of the item. Your invoice or your receipt serves as a guarantee slip. Possible claims should be addressed to La malle aux accordéons via mail 14 days after reception of the parcel at the latest. Past this term, they won’t be accepted. Any claim should contain the details about the use of the item and the location of the defectiveness. We reserve the right either to replace the defective item, to repair it, or to establish a credit note of the invoiced sum. The contractual warranty is strictly limited to the replacement of defective pieces. In case of an abnormal wear of the item due to negligence, an abnormal use or a lack of care on behalf of the Customer, our contractual warranty is not applicable. The replacement of the pieces or the item and the execution of the warranty do not result in an extension of the term stated above. Any handling not compliant to a normal use by any person not authorized by our services repeals the warranty.

RESPONSABILITIES

This warranty rules out any other express or tacit warranty, including any implicit warranty that the products are suited to a specific use. La malle aux accordéons is not responsible of the damage directly or indirectly resulting from the use of products, including property damage and, in so far as the Law entitles, physical injuries.

DISPUTES

In case of contest, the Tribunal de Commerce of Montpellier (Commercial Court of Montpellier) is the only competent jurisdiction. Our acceptance of this regulation does not constitute a novation or an infringement to the clause conferring jurisdiction, even in the case of an appeal in warranty or plurality of respondents.
